What Qualifies as Domestic Violence Under South Carolina Law

South Carolina’s Protection from Domestic Abuse Act (SC Code § 20-4-40) allows any household member to petition family court for an Order of Protection against another household member who has engaged in abuse. Abuse under the statute includes physical harm, bodily injury, assault, threats of physical harm, and sexual criminal offenses committed against a household member. A petitioner doesn’t need to have suffered a physical injury. Credible threats and conduct that places someone in reasonable fear of harm can be enough to pursue a Permanent Order.

Qualifying relationships include current or former spouses, people who share a child in common, and current or former cohabitants. Dating partners who have never shared a residence don’t qualify under this statute; they may pursue relief through magistrate court for harassment or stalking instead. Knowing which court and which process applies matters from the very first filing.

How the Order of Protection Process Works in Beaufort County

Hilton Head Island residents file for an Order of Protection at Beaufort County Family Court in Beaufort. A petition may be filed in the county where the abuse occurred or where either party resides, and there is no filing fee. Once a petition is filed, the court must schedule a hearing within 15 days.

South Carolina doesn’t have a statutory automatic temporary Order of Protection that issues between filing and the hearing. Whether a judge grants temporary relief before the hearing is discretionary and varies by county and judge. That makes familiarity with Beaufort County Family Court practice valuable. If an Order of Protection is granted under SC Code § 20-4-60, it can bar the respondent from the petitioner’s home, workplace, or school, prohibit all contact, and restrict communication entirely. Violating an Order of Protection is a criminal offense in South Carolina, carrying up to 30 days in jail or a $200 fine, with contempt penalties reaching up to one year in jail.
