Same-sex marriage became legal in South Carolina in November 2014, when a federal district court struck down the state’s ban in Condon v. Haley. The U.S. Supreme Court’s ruling in Obergefell v. Hodges secured that right nationwide in 2015, extending the right to marry and divorce equally to same-sex couples. But that ruling didn’t retroactively extend the legal marriage clock. South Carolina classifies marital property as assets acquired from the date of legal marriage, which means a couple together for 20 years before 2015 may find decades of shared property treated as non-marital under equitable distribution rules.

South Carolina is an equitable distribution state governed by SC Code 20-3-620. Courts weigh 15 statutory factors, including the duration of the marriage, each spouse’s contributions, and income. For same-sex couples, the legal marriage date can alter how several of those factors apply. Civil unions or domestic partnerships formed in other states don’t automatically start the marital property clock here, adding further complexity to asset and debt division.

The duration of a legal marriage in South Carolina directly affects alimony eligibility and how long support may last. Non-Biological Parental Rights

A non-biological parent who hasn’t legally adopted a child may have limited standing to seek custody or visitation in South Carolina family courts, regardless of how significant a role they played in raising that child. Being listed on a birth certificate doesn’t automatically confer parental rights on a non-genetic parent when divorce proceedings begin. Formal adoption or a parentage judgment is what establishes custody standing. When both spouses have legally adopted the child, or one is the biological parent and the other has adopted, the court applies the same best-interests-of-the-child standard used in all South Carolina custody proceedings.

South Carolina Divorce Grounds & Residency Requirements

South Carolina recognizes five grounds for divorce: adultery, desertion, physical cruelty, habitual drunkenness or drug abuse, and one no-fault ground requiring spouses to live separately for a continuous year. Living in separate bedrooms in the same home doesn’t satisfy the separation requirement. At-fault divorces may move forward as soon as 90 days after filing, once disputed issues are resolved.

If both spouses are South Carolina residents at the time of filing, the filing spouse must have lived in the state for at least three months immediately before filing. An uncontested divorce requires agreement on all key issues: property division, debt allocation, alimony, custody, child support, and visitation. A contested divorce goes before Beaufort County Family Court, where a judge makes binding decisions. South Carolina courts typically require mediation before a contested case reaches trial.
